Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PlateCheck website and mobile application (the "Service"), operated by PlateCheck ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, making a purchase, or otherwise using the Service, you confirm that you are at least 16 years of age and agree to comply with these Terms. We reserve the right to update these Terms at any time, and continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Service Description

PlateCheck provides vehicle information lookup services for UK registered vehicles. The Service includes:

• Free vehicle checks including MOT history, tax status, mileage records, ULEZ compliance, recall alerts, and CO2/road tax calculations.
• Subscription-based Pro features including unlimited AI summaries, vehicle garage, reminders, and Live Activities.
• Paid vehicle history checks (Basic and Advanced) covering stolen markers, write-off status, finance checks, keeper data, and valuations.

Vehicle data is sourced from official DVLA (Driver and Vehicle Licensing Agency) and DVSA (Driver and Vehicle Standards Agency) databases, as well as third-party data providers including Experian.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.

You must notify us immediately at support@platechecks.com if you suspect unauthorised access to your account.

4. Subscriptions & Payments

Pro Subscription

PlateCheck Pro is available as a monthly subscription, annual subscription, or lifetime one-time purchase. Subscription prices are displayed in the app and on our website at the time of purchase.

Billing

• Subscriptions are billed through the Apple App Store via your Apple ID account.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription through your App Store account settings.

Vehicle History Checks

History checks (Basic and Advanced) are one-off purchases. Once a check has been initiated and the report generated, it is non-refundable, as the data has been retrieved from third-party providers at cost.

Refunds

Subscription refunds are handled by Apple in accordance with their refund policies. For history check disputes, contact us at support@platechecks.com.

5. Data Accuracy Disclaimer

• DVLA and DVSA data is provided by Her Majesty's Government and is subject to the terms and availability of their APIs. We are not responsible for delays, inaccuracies, or omissions in government data.
• Experian data is provided by Experian Ltd and is subject to their data accuracy policies. Finance and stolen checks reflect records held at the time of the query and may not capture very recent changes.
• You should always conduct a thorough physical inspection and/or commission an independent vehicle inspection before purchasing a vehicle. PlateCheck reports should be used as one part of your due diligence, not the sole basis for a purchasing decision.
• AI-generated summaries and analyses are provided as a convenience and may not capture every nuance of the underlying data. Always review the full report data.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to scrape, harvest, or systematically extract data from the Service.
• Resell, redistribute, or commercially exploit vehicle data obtained through the Service without our written consent.
• Interfere with or disrupt the Service or its infrastructure.
• Use automated tools (bots, crawlers) to access the Service without our prior consent.
• Impersonate another person or misrepresent your identity.

7. Intellectual Property

All content, features, and functionality of the Service - including but not limited to the design, code, text, graphics, logos, and trademarks - are owned by PlateCheck or its licensors and are protected by UK and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Limitation of Liability

To the fullest extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• PlateCheck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or goodwill.
• Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid to PlateCheck in the 12 months preceding the claim.
• We are not liable for any decisions you make based on data obtained through the Service, including vehicle purchase decisions.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, if we reasonably believe you have violated these Terms or engaged in fraudulent or harmful activity.

You may terminate your account at any time by contacting us at support@platechecks.com. Upon termination, your right to use the Service will cease immediately. Any unused history check credits are non-refundable.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after the posting of changes constitutes acceptance of the modified Terms.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
